Data Protection

The protection of your personal data is very important to Wirecard Bank AG (hereinafter referred to as "Wirecard"). Personal data is collected and used by Wirecard for specific purposes in accordance with statutory provisions, in particular in accordance with the provisions of the German Federal Data Protection Act [Bundesdatenschutzgesetz, "BDSG"] and the provisions of the German Teleservices Data Protection Act [Teledienstedatenschutzgesetz, "TDDSG"]. The following declaration explains to you what personal data Wirecard collects when keeping accounts in connection with Wirecard transactions and when you visit the Wirecard website and how said data is used by Wirecard.

Contents of Declaration

1. Scope of Application for this Declaration

Unless otherwise mentioned, this data protection statement only regulates how Wirecard deals with personal data that you disclose to Wirecard via the website www.mywirecard.de or in connection with the reloadable prepaid MasterCard named "Wirecard" (hereinafter referred to as "Wirecard" or "Card"). For other products of Wirecard AG or of Wirecard Bank AG, the data protection statements of the respective products apply.↑ TOP

2. Collecting Data Associated with Account Management and Transactions

In this section you will learn what data Wirecard collects to manage and administer accounts and in connection with transactions.

a. Information required for the Wirecard account

In order to be able to open a Wirecard account for you, Wirecard requires your name, your address, your date of birth, your telephone number, and your e-mail address. You will also be asked to enter this personal data in order to use and manage your Wirecard account. When you load money to your Wirecard account, Wirecard also needs your credit card data or your bank account details. In addition we also ask you to answer a security question and to specify an answer to this security question (You can find out more about this in the "Help/FAQ" section on the Wirecard website). This data is collected in order to check your identity if your password is lost, to execute transactions securely, and to protect you against fraud.

b. Transaction data

In order to receive money via your Wirecard account or to send money from one account to another, we require information on the transaction concerned. This includes the amount, the type of transaction (purchase of goods, purchase of services, or money transfer), and the other party's e-mail address or account number. For each of these transactions, we store said data in order to be able to execute the transaction and, if necessary, to check it. In addition, in order to combat misuse we retain the IP address of the computer from which the login was made for a transaction.

c. Data of non-customers

If a Wirecard customer requests a payment to or from a person who is not yet a customer of Wirecard, Wirecard stores said person's personal data (contact and payment details) so that the Wirecard customer can have access to a precise overview of all transactions, including failed transactions, in his history of transactions. The data of non-customers is not used for marketing purposes and is not passed on to third parties. Non-customers also have the rights to information, correction, and deletion of personal data, which are described in Section 10.

d. "Is my data secure?" – PCI certification

Wirecard uses the most up-to-date technology, the most stringent testing procedures, and experienced specialists in order to protect your data and safeguard it against misuse. All the data is stored in encrypted form and is also only transferred using state of the art encryption. Wirecard is furthermore certified in compliance with the Payment Card Industry Data Security Standard (PCI). PCI is a standard defined by Visa and MasterCard that ensures the safe handling of card and account data. ↑ TOP

3. Use of Your Data

Wirecard collects, stores, and processes your personal data on servers in Germany.

a. For Wirecard services

Wirecard uses your personal data to fulfill your contract with Wirecard, to process transactions, to offer customer service, to improve products and services, and to be able to provide you with further products, such as, for example, the Wirecard MasterCard debit card.

In the Wirecard virtual MasterCard registration process, you agree that Wirecard may from time to time send you product offers from Wirecard Bank AG or its partners. Wirecard will send you an e-mail containing an activation link to the e-mail address you provided during the registration process. By clicking on this activation link you confirm your e-mail address and your consent.

b. Providing information to other Wirecard customers

Personal data such as your credit card number, account data, or other financial data will not be transmitted to your Wirecard payees or persons who have made payments to you via Wirecard, unless you give us your consent to pass on this information or we are legally obligated to pass on this information. As registered Wirecard users, other Wirecard customers will - if you have made payment to them with Wirecard or if they try to make a Wirecard payment to you - be shown the following data so that the transaction can be executed: your name, your e-mail address, your telephone number, the date of registration, and information as to whether you have a verified account. If you maintain a business account at Wirecard, Wirecard additionally shows other Wirecard customers your website address (URL) and the customer service contact details which you provided to us for this purpose.

c. Providing information to merchants

Wirecard works together with merchants so that they can accept payment by Wirecard customers. Merchants who use this service may receive transaction-related personal data related to you from Wirecard. This personal data should allow the merchants in individual cases to verify the details which you provided to the merchant, to assess the risk associated with the transaction, or to confirm the existence and the status of your Wirecard account.

In the Wirecard virtual credit card registration process, you agree to Wirecard providing your personal data (contact and payment details) and information about the existence and validity of your Wirecard account to merchants participating with Wirecard.

If you purchase goods or services via Wirecard, some merchants may insist that you provide a delivery address that has been verified by Wirecard as the credit card's confirmed invoicing address. You do not have to provide this information. However, this could result in the merchant's refusal to accept your Wirecard payment and, as a result, the transaction may not be successfully completed. Personal data, which Wirecard receives from the merchants in order to verify the existence of your Wirecard account, is not stored by Wirecard. ↑ TOP

4. Verification of Your Data

a. Identity check and card authorization

Wirecard would like to protect all customers against fraud. If you register a credit or debit card with Wirecard, card authorization and fraud-screening services are used to check firstly whether the data entered by you is correct and secondly whether these cards have been reported as stolen or missing.

In the Wirecard virtual MasterCard registration process, you agree to allow Wirecard to transmit your personal data to fraud-screening centers and credit agencies for the purposes of identity checking and card authorization.

b. Verification of addresses in specific cases

If information that you gave us when registering cannot be verified, or if a check has been paid out to an address other than the credit card's verified invoicing address, Wirecard may ask you for further personal data in order to be able to execute the transaction securely. If necessary, Wirecard will, for example, ask you for a copy of your identity card, a credit card statement, and/or a current utility bill in order to be able to verify your address. ↑ TOP

5. Storing Your Visits to the Website www.mywirecard.de

a. Website

When visiting the Wirecard website, certain data, such as, e.g., your IP address, browser type, access times, the name of your Internet service provider, the website from which you visit the Wirecard website and to which you go when you leave the Wirecard website, is automatically transmitted by your computer to our servers. Wirecard does not store websites that you visit prior to visiting and after leaving the Wirecard website. Wirecard collects information about which pages of Wirecard's Internet presence you have visited, which browser you use, and at what time you accessed the website. Wirecard uses this information to better understand its customers' preferences, to optimize server capacities, and to further improve the service offered and the clear arrangement of the Wirecard website. Except for the purposes of pursuing any unauthorized access to our Internet content, we - as a general rule - use the information that is transmitted to us automatically merely on an anonymous basis rather than as data relating to an individual.

b. Cookies

In order to design Wirecard's Internet presence to be as easy to use as possible we, like many other companies, use so-called cookies. Every time you log into your Wirecard account by entering your user name and password, we send a so-called session "cookie" to your computer. "Cookies" are small text files that allow the user to be recognized when visiting Wirecard's website. Wirecard uses cookies in order to measure and manage the frequency with which pages are called up and general page navigation. When you log out of this session, the "cookie" is deactivated and you can then only access your data again by logging in again. In addition, Wirecard uses a longer lasting cookie in order to show your e-mail address in the login window of the Wirecard account. This saves you from having to type in your e-mail address again. The cookie files are encrypted so that your e-mail address and your other data can only be used by Wirecard. ↑ TOP

6. Transmission to Third Parties

Wirecard will neither sell nor lease your personal data to third parties. Wirecard also will not share your personal data with third parties unless the purpose of the contract makes it necessary to do so or you have given Wirecard consent to do so. The circumstances in which data of Wirecard customers is passed on to third parties are described in this data protection statement. Apart from this, we draw your attention to the fact that Wirecard may use order data processing services of other companies, who collect, use, or process data on behalf of Wirecard, in accordance with statutory principles. These companies are not third parties for the purposes of data protection, rather they act on behalf of Wirecard.↑ TOP

7. Questionnaires and Surveys

From time to time Wirecard offers its customers the opportunity to voluntarily complete questionnaires and participate in surveys. The purpose of these questionnaires and surveys is to record demographic data, or the interests and needs of customers. How the data collected with the respective survey is to be used will be explained in detail in the respective survey. If you are approached in connection with such a campaign, you have the option of objecting to any further use of your personal data for this purpose. 8. Contacting Wirecard by Post, E-mail, Telephone, or Fax

If you contact Wirecard by post, e-mail, telephone, or fax, Wirecard collects, uses, and stores your personal data for processing your query. Wirecard analyses said data in order to investigate potential cases of fraud and violations of our conditions of use and in order to improve customer service.↑ TOP

9. Deletion of Data

If your data is no longer necessary for the above-mentioned purposes it will be deleted. Insofar as data has to be kept for tax purposes, said data will be blocked. This data will then no longer be available for any other use.↑ TOP

10. Right to Withdraw Consent, Information, Amendment, and Deletion

Your consent to the collection, use, and processing of your personal data can be withdrawn at any time, on a going forward basis, by sending an e-mail to service@wirecard.de. If you have any questions concerning data protection, please write to the above e-mail address.
